FARMERS ACTS – 2020

Introduction

The Constitution of India holds the absolute power or authority in India. In this dynamic

world changes happens frequently and fastly. Nowadays we need to update ourselves for current

dynamic society. Now we the people also changed many things our life like lifestyle, food habits

and clothing style. During this pandemic, we changed our life more digitalized. Even starting

from 1000 years ago to till now, only one matter never changed that is Change. These changes

are help for many part of the society, it include rural & urban. When one good thing comes for

that against one negative thing also come. India is a country with huge population in it. When a

change occurred, we need new laws and regulation for regulate that part the particular purpose.

The Parliament has power to make new laws, amend existing laws and repeal old laws. So In this

article I mainly focused on newly introduced farmers Acts 2020.

Farmers Acts- 2020

The Law making body of India has authority to make new laws, amend existing laws and

repeal old laws. For this purpose, they draft a bill and that bill needs to get passed in both houses

of parliament. After that bill needs to get assent of the president to become an Act. On

September 14, 2020 three bills introduced in Lok Sabha for “aimed at transformation of

agriculture in the country and raising farmers’ 1 . And the bills are the Farmers’ Produce Trade

and Commerce (Promotion and Facilitation) Bill 2020, the Farmers (Empowerment and

Protection) Agreement on Price Assurance and Farms Services Bill,2020 and the Essential

Commodities (Amendment) Bill,2020. After that, on September 20, 2020 these bills got

approved in Rajya Sabha. And these Bills received the assent of President on 24 th September. On

27 th September, 2020 these three Bills become an Acts.

The Farmers’ Produce Trade and Commerce (Promotion and Facilitation)

Act, 2020

This Act contains five chapters and twenty sections. The main purpose of this Act is to

provide freedom of choice to farmers and traders for sale and purchase of farmers’ produce. And

this Act promotes efficient, transparent and barrier-free intra-State trade and inter-State trade and

commerce of farmers’ produce. And it provides facilitation framework for electronic trading and

related matters.

The Farmers (Empowerment and Protection) Agreement on Price Assurance

and Farm Services Act, 2020

This Act contains four chapters and twenty five sections. The main purpose of this Act

is to provide for a national framework on farming agreement that protects and empowers farmers

to engage with agri-business firms, processors, wholesalers, exporters or large retailers for farm

services and sale of future farming produce at a mutually agreed remunerative price framework

in a fair and transparent manner and for matters connected therewith. 2

The Essential Commodities (Amendment) Act, 2020

This Amendment Act inserts Section 3(1A) in the Essential Commodities Act,

1955.This section 3(1A) give exemption to section 3(1).In section 3(1A) deals that Central

Government may regulate the supply of foodstuffs, including cereals, pulses, potato, onion,

edible oilseeds and oils under only extraordinary circumstances like war, famine, extraordinary

price rise and natural calamity of grave in nature 3 . Say it in simple words they remove these

items in the essential commodities. This amendment Act provides a clear framework to impose

stock limits will be based on the price trigger.

Conclusion

When one new thing comes, it has good and bad side. These Acts provides freedom to

farmers sell anywhere and contract farming with corporate investors for mutually agreed

remuneration. But in opposition it leads to corporatisation of agriculture. 4
