MEANING OF THE WORD :

Defense of Consent is the meaning of the maxim. In other words , when the person agrees to suffer harm , he is not liable to claim any damages for the same.

CASE LAW RELATING TO THIS MAXIM:

WOOLDRIGE V. SUMNER

The fact of the case is the plaintiff was a photographer at a horse show. While he was standing at the boundary of the arena , one of the horses galloped at a significant speed towards him after the rider who was the defendant lost the control over the horse and knocked the plaintiff down. By applying Volunti Fit Injuria , the Court held that the defendant can’t be held liable as the plaintiff has given consent to any such harms while buying the tickets to the show.
